Buying a resale property in Cyprus: a practical due-diligence checklist

Prepare a resale purchase around title, condition, occupation, finance and handover. Know what a viewing, registry search and independent lawyer each contribute.

THE ANSWER UP FRONT

A resale buyer should establish what is being transferred, who owns it, which burdens or rights affect it, what condition it is in and how payment and handover will work. Use separate legal and technical checks where appropriate. A well-organised shared case supports those enquiries but does not certify the home.

Define the property you are buying

Obtain the available registered details and compare them with the home shown to you. Ask about parking, storage, outdoor areas and any other rights included in the price. An advert’s description may be useful, but it is not the legal definition of the interest being transferred.

Tell your lawyer whether a separate title is available or whether the seller is offering rights through an existing contract. The DLS explains different purchase routes. The right questions depend on the route, so establish it before relying on a generic completion checklist.

Use a viewing for observation, not legal approval

Record the layout, apparent condition and anything you want a qualified professional to inspect. Ask about alterations, recurring problems, maintenance and proposed inclusions. Return at another time if your decision depends on traffic, noise, access or how the surroundings are used.

A surveyor, engineer or other relevant specialist may identify issues a viewing cannot establish. Ask what their report covers and what it excludes. Neither the seller’s confidence nor a platform task marked complete substitutes for a technical assessment.

Have the registered position and permissions reviewed

Ask your lawyer which searches, title documents and building or planning information are needed. Registered burdens, outstanding permissions and physical alterations are separate questions. A certificate that answers one should not be treated as an answer to all.

Keep the response linked to the enquiry and record any further work needed. If information is missing or inconsistent, ask the professional to explain the risk and options before proceeding. Do not let a target move date become a reason to ignore an unresolved ownership or permission issue.

Understand occupation and continuing obligations

Ask who currently occupies the property and on what basis. Record the proposed vacant-possession or continuation arrangement and have it addressed in the agreement. A viewing without a tenant present does not prove that there is no occupation arrangement.

For shared buildings, ask about current common expenses, management contacts, planned work and any continuing obligations associated with the unit. Confirm how any outstanding sums will be dealt with instead of assuming the buyer automatically starts with a clean account.

Build a budget that reflects the actual purchase route

Separate the price from professional fees, official charges, applicable tax, finance, inspection and moving costs. New-build and resale assumptions should not be mixed. Obtain current case-specific figures rather than applying a percentage remembered from another person’s purchase.

Agree who is buying any Properly package. Opening a case does not automatically charge the buyer or seller. The €3,995 package is a defined service arrangement, not a replacement for your purchase funds, lender costs or official liabilities.

Use digital coordination while preserving independent advice

The seller can invite you into a Properly case so practical questions, requested documents and actions remain together. Establish whether the accepted lawyer represents you or the seller. A common workspace does not make one lawyer an impartial adviser to both parties.

Ask for a clear explanation of contract conditions, deposit arrangements, payment instructions and the official transfer steps. Keep confidential advice in the appropriate private channel. The useful alternative to manual coordination is a clearer record of who does what, not the removal of professional judgement.

Your preparation checklist

  • Match the physical home to the registered interest.
  • Arrange appropriate independent legal and technical checks.
  • Clarify occupation and shared-building obligations.
  • Budget for case-specific official and professional costs.
  • Confirm contract, payment and handover instructions before committing.

Questions about your next move.

What should I check before buying a resale home?

Identify the registered interest, owners, burdens, permissions, condition, occupation, continuing obligations and completion route with the relevant professionals.

Can I rely on the seller’s lawyer for independent advice?

A lawyer representing the seller is not automatically your independent adviser. Confirm representation and obtain your own advice where needed.
